Your use of this website is subject to the terms and conditions as set out, and may be amended from time to time by us.

  • This website is the property of Sports Performance Equipment Ltd and is directed at UK residents only.

  • Due to the nature of the software and the Internet, no guarantee is given of uninterrupted or error free access to or running of this website or the information-transactions conducted through it.

  • Sports Performance Equipment Ltd shall not be liable for any failure in processing your details due to software or Internet errors or unavailability, or circumstances beyond its reasonable control.

  • Sports Performance Equipment Ltd makes no warranty that this site is free from errors, defects or viruses.

  • We will use all reasonable efforts to ensure that the information published on this website is complete, accurate and up-to-date, but representations or warranties are made (express or implied) as to the accuracy or completeness of such information.

  • Sports Performance Equipment Ltd cannot accept any responsibility for any loss arising directly or indirectly from the use of, or any action taken in reliance on, any information appearing on this website or any other website to which it may be linked.

Terms of Trading

1. Pricing and VAT
Due to Sports Performance Equipment Ltd currently being a small bespoke company, the company is not registered with VAT at this present time. Pricing will be as per the published price list unless otherwise stated. The company has the right to amend prices at any time.

2. Order Confirmation

Once an order has been placed, a confirmation of receipt will be emailed. The Contract between Sports Performance Equipment Ltd and the Buyer will commence on despatch of the items at which point a despatch email will be sent.

3. Delivery and Packaging
Charges apply to all UK mainland deliveries.
Delivery will usually be made within 48 hours of the order/payment subject to stock availability. Overnight deliveries will incur a further charge at the prevailing rate.

4. Overseas Orders
Territories outside UK mainland and Northern Ireland may incur additional charges in respect of Packaging, Shipping and Delivery charges. Costs will be confirmed on the acceptance of the order and payment will be required before delivery.

5. Returns and Refunds
5.1) Notification of damage or shortages must be made to Sports Performance Equipment Ltd as soon as possible after receipt and no later than 48 hours. If the packaging is damaged on receipt, you may refuse delivery and you must inform us immediately, preferably by emailing info@sportsperformanceequipment.co.uk

5.2) Please inform us as soon as possible if the goods have not arrived on our planned delivery date, preferably by emailing info@sportsperformanceequipment.co.uk

5.3) IMPORTANT – do not send any goods back without contacting us first.  We will then advise the best means of return.

6. Unwanted Items
If you just don’t want the items you have received from us, you have 14 days from the date of receipt to return them back to us. A reasonable examination of the goods can be carried out and we may make a deduction on the refund price should we deem the goods to have been handled excessively. The returned product/s must include all of the contents including instructions and packaging. We also reserve the right to make a deduction from refunding the full purchase price if we believe (on examination of the returned goods) that they exhibit use (including self assembly and attempts at disassembly). The amount of deduction will be based on the extent of the diminishment in the goods value. We do not cover the cost for returning the products back to us, and we recommend that you obtain a proof of postage receipt when sending the items back, as we do not accept responsibility for products lost or damaged in the post. We also do not offer a collection service. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

 

We do not offer a loan or trial service and our offer of a refund does not apply if you have used the product.

7. Faulty Goods
If a product you have ordered becomes faulty, please contact us as soon as possible preferably by emailing info@sportsperformanceequipment.co.uk

8. Items not Included in our Returns Policy

We are unable to accept returns on products that have been personalised, made to order or customised to your requirements. Specifically, products from our manual therapy Section are non refundable due to health protection and hygiene reasons i.e. Massage Products.

9. Product Suitability

Please note that gym strength equipment (Benches, Racks, Bars, Weights) products on the Sports Performance website are designed for Home use and carry a home use warranty only, unless stated otherwise. Equipment purchased from our website and used in a non-domestic environment will render the warranty null and void unless the equipment description states it is suitable for commercial use.

If you are planning to purchase equipment for commercial use, or have any questions regarding the warranty for commercial equipment, please email our Sales Department at info@sportsperformanceequipment.co.uk who will be able to advise you on the suitable equipment.

Buying Items from our Mail Order Returns / Ex-Display Section Items purchased from our mail order returns/ex-display models section of our website may be partially or fully boxed/assembled and may have some sort of cosmetic damage. All goods will have been tested and will be in full working order and covered by a warranty. Any such minor defects will be made known in the product description.

10. Product Warranty
Products may be subject to Terms and Conditions contained in the Manufacturer’s Warranty. These are in addition to your consumer rights.

All new equipment sold by Sports performance Equipment is covered for domestic use only, (excluding consumable parts), unless the item states it is suitable for light commercial or commercial use. In many cases the warranty is greater than this. The warranty on equipment we sell varies from manufacturer to manufacturer. It can include a full on site repair facility or a 'back to base' warranty. In some cases, where there is a minor fault, the manufacturer will send a part by mail for the customer to fit (This warranty excludes consumable parts and damage caused by accident, or misuse). Equipment sold for home or commercial use, is warranted for use in a normal habitable building environment. Manufacturers reserve the right to cancel warranties if equipment is used in a non-standard environment. Warranty for light commercial or full commercial equipment varies, please contact our sales department to clarify warranty status on individual equipment.

If an item develops a fault, please contact us stating the equipment you have, (brand and model number), serial number and a brief description of the fault. Sports performance Equipment will either arrange to send a part for the customer to fit, if this is practical and simply applied or affixed by a reasonable person, send an engineer to site, or in some instances, ask that the goods be returned to our warehouse for examination. Goods must be well packaged prior to collection. No goods will be accepted into our warehouse without prior authorisation from Sports Performance Equipment Ltd. Sports Performance Equipment Ltd will then repair or replace the equipment with an equivalent or better model and deliver the goods back to the customer at our expense.

11. Law
All Contracts by Sports Performance Equipment Ltd for the sales of goods shall be deemed in all respects to be Contracts made, performed and construed according to English Law.

13. Data Protection

All customer information will be treated under the terms of the Data Protection Act. We will not pass on your details to other companies. We may identify and inform you of other products and services offered by Powerhouse which would be of interest to you. You must tell us if you do not wish us to do so.  We do not store credit card details nor do we share customer details with any 3rd parties.

14. Note
A copy of these terms of trading are available upon request. The Company reserves the right to amend these terms or prices without prior notice. All prices are correct at time of going to press. All product specifications may change due to manufacturer’s product development without prior notification.
